Terms and Conditions for Social Media Management Package Service
1. Service Overview:
The Social Media Management Package Service (hereinafter referred to as "the Service") offers clients professional social media management for their Facebook, Instagram, LinkedIn, and TikTok accounts, based on the package selected.
2. Package Details:
The number of weekly posts on each social media platform will depend on the package selected by the client. Specific details and frequency of posts for each platform are outlined in the Service Agreement.
3. Payment Terms:
Clients agree to make payments for the Service as per the pricing and billing schedule specified in the Service Agreement. Payments shall be billed on the second week after the first day of agreement and shall continue on a recurring basis throughout the service duration.
4. Service Duration:
The Service will be provided for the duration specified in the Service Agreement, commencing from the first day of agreement and continuing for the agreed-upon period, unless terminated earlier as per the termination clause outlined below.
5. Content Approval and Revisions:
Clients are responsible for approving all content before it is posted on their social media accounts. The Service provider will share proposed posts for approval in a timely manner. Clients shall have the opportunity to request reasonable revisions to the content.
6. Content Ownership and Rights:
All content created by the Service provider for the client's social media accounts shall remain the property of the client. Clients grant the Service provider the right to use and publish the approved content for the sole purpose of social media management.
7. Access to Social Media Accounts:
Clients agree to provide necessary access credentials to their social media accounts to enable the Service provider to post content and perform other relevant social media management tasks. The Service provider will treat the provided credentials with utmost confidentiality and security.
8. Termination of Service:
Either party may terminate the Service by providing written notice to the other party. In the event of termination, the Service will be completed until the end of the billing cycle. Clients will be responsible for any outstanding payments for services rendered up to the termination date.
9. Liability and Indemnification:
The Service provider shall not be held liable for any damages, losses, or claims arising from the client's social media posts, content, or interactions with followers. Clients agree to indemnify and hold the Service provider harmless against any claims, losses, or liabilities related to the Service.
Both parties shall maintain confidentiality regarding any information shared during the course of the Service Agreement.
11. Force Majeure:
Neither party shall be held liable for any failure or delay in performing their obligations due to circumstances beyond their reasonable control, including but not limited to natural disasters, government actions, or technical failures.
12. Governing Law and Jurisdiction:
These Terms and Conditions shall be governed by and construed in accordance with the laws of New Zealand. Any disputes arising under or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of New Zealand.
By agreeing to these Terms and Conditions, the client acknowledges and accepts the provisions herein and enters into the Social Media Management Package Service Agreement.
